These terms of service are entered into by and between You and  Prep Experiences Partners LLC ("Company," "we," "our," "us", or “Prep”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively "Terms of Service"), govern your access to and use of www.pepusa.org, including any content, functionality, and services offered on or through www.pepusa.org (the "Website").

  • Attack the Website via a denial-of-service attack or a distributed denial-of-service attack.

Intellectual Property Rights

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as follows:

  • Your computer may temporarily store copies of such material in RAM incidental to your accessing and viewing those materials.

  • You may store files that are automatically cached by your Web browser for display enhancement purposes.

  • You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication or distribution.

  • If we provide social media features with certain content, you may take such actions as are enabled by such features.

  • Delete or alter any of the copyright, trademark, or other proprietary rights notices from copies of materials from this site.

This Privacy Policy applies regardless of the way you interact with our Services or the type of device or other means you use to access our Services.

 

Automatically collected information (including cookies and geolocation)

 

When you use our Services, we may receive technical information such as your browser type, the type of operating system you use, your geolocation, the name of your internet service provider, mobile advertising identifiers, and pages visited on our Services. Prep gets this information by using technologies, including cookies, web beacons, and mobile device geolocation to provide and improve our Services and advertising, including across browsers and devices (also known as cross-device linking). We also use this information to verify that visitors meet the criteria required to process their requests and for reporting activity on our Services. This technical information may be combined with information that is personally identifiable in order to personalize our Services and advertising to your interests, including across browsers and devices. Text messaging program

 

By accepting these Terms of Service and providing your mobile number, you expressly consent to receive marketing or non-marketing text messages, as applicable, from Prep and its affiliates and others texting on its behalf, at the telephone number(s) that you provide. You may opt-out of these communications at any time. Consent to receive text messages is not a condition of any purchase.

Program Description

​

Prep text messages are intended to provide you with marketing and promotional information regarding Prep products and services. We may also provide you with transaction-related information.  

​

Message Frequency

​

The number of Prep text messages that you receive will vary depending on which Prep text messaging programs that Prep decides to roll out and the frequency of the messages sent by those programs.

​

Cost

​

Message and data rates may apply to each text message sent or received in connection with Prep text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. Prep does not impose a separate fee for sending Prep text messages; however, you are responsible for any fees imposed by your mobile carrier of any kind whatsoever.

How to Opt-Out

​

To stop receiving text messages from a specific Prep text messaging program, text STOP to the five-digit short code for the text messaging program from which you no longer wish to receive messages. You acknowledge that you may then receive one (1) final message from Prep confirming your opt-out of that text messaging program. Following such confirmation message, no additional text messages associated with that program will be sent to you unless you re-activate your subscription. This will only opt you out of the specific text messaging program associated with that five-digit short code. You will remain opted in to other Prep text messaging programs.

Your Mobile Telephone Number

​

You represent that you are the account holder for the mobile telephone number(s) that you provide to Prep. You are responsible for notifying Prep immediately if you change your mobile telephone number. You may notify Prep of a number change by contacting Prep at hello@pepusa.org

​

You agree to indemnify Prep in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Prep if you change your telephone number including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Access or Delivery to Mobile Network is Not Guaranteed

​

It is your responsibility to determine if your mobile carrier supports text messaging and if your mobile device is capable of receiving text messages. Your receipt of our text messages is subject to the terms and conditions of your agreement(s) with your mobile carrier. 

​

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions.  You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Prep’s control, and Prep is not responsible or liable for issues arising from such network services (e.g., delayed or undelivered messages or the security of any messages).

YOU WAIVE AND HOLD HARMLESS COMPANY AND ITS PARENT, SUBSIDIARIES, AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS, AND SUCCESSORS FROM ANY AND ALL CLAIMS RESULTING FROM ANY ACTION TAKEN BY THE COMPANY AND ANY OF THE FOREGOING PARTIES RELATING TO ANY, INVESTIGATIONS BY EITHER THE COMPANY OR BY LAW ENFORCEMENT AUTHORITIES.

Dispute Resolution
​

At Company’s sole discretion, it may require you to submit any disputes arising from these Terms of Service or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Florida law. (If multiple jurisdictions, under applicable laws).

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN 1 YEAR(S) AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
